You Are Here: Home » Finance » Removing a Bankruptcy Or Foreclosure From Your Credit Report

Get this straight, no creditor prays that their debtor files bankruptcy because it means that they will never get their money back. I will explain how you can delete one from your file in a moment, but before then I need you to understand that you can prevent the negative effects of declaring yourself bankrupt by negotiating with your creditor your willingness to pay and exactly how much you want to pay and the duration of payment.

Creditors will readily accept this option than that of you being bankrupt and never paying them their money. Once this has been negotiated, you simply get on the wage earner plan which will require a third party known as the trustee to make fractional deductions from your wages and settle the creditor.

On the other hand, if you’ve already declared yourself bankrupt and it has now become a cog on your file, you can still get it off. Removing it requires patience. If the account or a foreclosure for that matter has spent about 3 years on your report, then you should make efforts to challenge this with the credit bureau that listed it on its own version of your file. If all three (Transunion, Equifax, and Experian) have it listed, then you will be using the process for all three.

You will compose and mail dispute letters to the bureau with the negative account and they will react by investigating it. But you can get lucky on this one because the bureau may be unable to get its hands on the court documents of the filing for a simple reason that most courts move out documents from their vicinity to a storehouse usually after a three-year period. As a result, the bureau may be unable to assign an agent or find someone to dig up the document from the archives.
